Terms of Service

Welcome to GoFuel

These Terms of Service ("Terms") govern your access to and use of the GoFuel mobile application and related services (collectively, the "Service") provided by JCobiq Energy Solutions ("GoFuel," "we," "us," or "our").

By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree with these Terms, do not use the Service.

1. Eligibility

To use GoFuel, you must:

• Be at least 18 years of age.
• Be a resident of Nigeria with a valid Nigerian phone number.
• Have the legal capacity to enter into binding contracts.
• Provide accurate and complete registration information.
• Not be prohibited from using the Service under applicable law.

By using GoFuel, you represent and warrant that you meet these eligibility requirements.

2. Account Registration and Security

2.1 Account Creation

To access most features of the Service, you must create an account by providing:

• A valid Nigerian phone number.
• Your full legal name.
• A secure password.
• Additional information as required for identity verification, security, payments, or credit eligibility.

2.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized access or security breach.

We are not liable for losses resulting from your failure to protect your account credentials, except where otherwise required by applicable law.

2.3 Account Suspension and Termination

We may suspend or terminate your account if:

• You violate these Terms.
• You engage in fraudulent or illegal activities.
• You fail to repay credit obligations.
• Your account shows suspicious or potentially fraudulent activity.
• We are required to do so by law or a competent regulatory authority.

3. Wallet and Payment Services

3.1 Wallet Funding

• You may fund your GoFuel wallet using debit cards, bank transfers, or other payment methods supported by GoFuel.
• Payments are processed through our payment and financial-service partners.
• Wallet balances do not earn interest.
• Minimum wallet funding amount: ₦500.
• Maximum wallet balance: ₦500,000.

3.2 Wallet Withdrawals

• Direct cash withdrawals from the wallet to bank accounts are **not permitted** for users.
• GoFuel wallet balances are strictly for the procurement of fuel and other GoFuel services from partner vendors.
• Withdrawal functionality is exclusive to registered and verified GoFuel vendors ONLY, for the purpose of transaction settlement.
• Funds transferred to the GoFuel wallet are designated for fuel transaction settlement and are not eligible for cash redemption by users.

3.3 Transaction Fees

GoFuel aims to clearly disclose all GoFuel charges before a transaction is confirmed. We do not intentionally apply hidden GoFuel fees.

• Wallet funding: GoFuel does not currently charge a wallet-funding fee. If a third-party payment processor applies a separate processing charge, the applicable charge will be disclosed before the transaction is completed where applicable.
• Standard fuel requests: No GoFuel service fee is currently charged for standard wallet-funded fuel requests, unless expressly displayed before confirmation.
• Fuel Assist Credit: A 3% service charge applies to the approved fuel transaction amount when a user chooses Fuel Assist Credit.
• Fuel Assist Credit interest: 0% interest. The 3% service charge is a disclosed service charge and is separate from interest.
• Early savings-plan withdrawal: A 5% penalty may apply where an applicable locked savings plan is liquidated to the main wallet early, as displayed in the relevant savings terms.

Before confirming a Fuel Assist Credit transaction, the application will display the fuel amount, the applicable 3% service charge, and the resulting amount payable by the user.

We may change our fees in the future. Any new or increased fee applicable to a service will be disclosed to users before it becomes applicable, subject to applicable law.

4. Fuel Savings Plans

• You can create locked savings plans with specific goals and durations.
• Savings plans may be manual or automated with recurring deposits.
• Funds in locked savings plans are subject to the terms displayed when the savings plan is created.
• Early withdrawal of a locked savings plan (liquidation to the main wallet) may incur a 5% penalty, where applicable.
• Automated savings require sufficient wallet balance.
• Failed automated deposits do not incur a GoFuel fee.

5. Fuel Assist Credit

Fuel Assist Credit is GoFuel's credit/facilitation feature that allows eligible users to obtain fuel from participating vendors and repay the applicable credit obligation within the stated repayment period.

Approved Fuel Assist Credit is restricted to eligible fuel purchases at participating GoFuel vendors. It is not provided as unrestricted cash that can be withdrawn to a personal bank account. User withdrawals are strictly prohibited; withdrawal functionality is exclusive to registered vendors ONLY.

5.1 Credit Eligibility

To access Fuel Assist Credit, you must:

• Complete required identity verification, including BVN verification where required.
• Have an active GoFuel account for the minimum period specified by the application.
• Have completed the required number of successful qualifying transactions.
• Have no outstanding overdue credit where applicable.
• Pass GoFuel's applicable credit assessment and eligibility criteria.

Meeting these requirements does not guarantee approval. Credit availability, limits, and eligibility may vary based on the user's account activity, verification status, repayment history, risk assessment, and other applicable criteria.

5.2 Credit Terms and Charges

• Credit limits: ₦5,000 – ₦100,000, subject to eligibility and applicable limits.
• Purpose: Eligible fuel purchases at participating GoFuel vendors.
• Repayment period: 7–14 days from the applicable fuel procurement date, as displayed when the credit is approved.
• Service charge: 3% of the approved fuel transaction amount.
• Interest: 0%. GoFuel does not charge interest on the Fuel Assist Credit facility.
• Late payment: Where applicable, a late payment fee of 5% of the outstanding amount may apply after the stated due date, together with an additional ₦500 per week while the amount remains overdue.
• Maximum outstanding credits: 2 active credits at a time, subject to eligibility.

Example: If you use Fuel Assist Credit for a ₦20,000 eligible fuel purchase, the 3% service charge is ₦600. Your initial credit obligation will therefore be ₦20,600, excluding any applicable late-payment charges that may arise if you fail to repay by the stated due date.

No additional GoFuel credit charge will be added to a Fuel Assist Credit transaction unless it has been disclosed to you in these Terms or clearly presented to you before you confirm the applicable transaction.

5.3 Repayment

• You may repay eligible credit using the repayment methods made available in the GoFuel application.
• Partial repayments may be permitted where supported by the application.
• GoFuel may send payment reminders before and on the applicable repayment due date.
• Late or missed repayments may affect future credit eligibility, credit limits, or account access.
• Persistent non-payment may result in account restrictions and, where lawful and appropriate, debt-recovery measures.

5.4 Auto-Debit Authorization

Where auto-debit is available and you enable it, you authorize GoFuel and/or its applicable payment provider to process repayment in accordance with the authorization you provide.

You remain responsible for repaying your outstanding credit obligation even if an attempted auto-debit is unsuccessful.

6. Fuel Requests and Vendor Verification

6.1 Requesting Fuel

• You can request fuel at participating stations shown on the map.
• Requests must specify the applicable fuel type and quantity.
• Payment is deducted from your wallet or approved through Fuel Assist Credit.
• You will receive a unique QR code and/or request code for vendor verification.
• Fuel requests may expire after the period displayed in the application.

6.2 Vendor Fulfillment

• You must present your QR code or request code to the vendor.
• The vendor will scan or enter the code to confirm the transaction.
• Once verified, the fuel will be dispensed.
• If a vendor cannot fulfill an eligible request, GoFuel will process the applicable refund or resolution in accordance with its refund procedures.

6.3 Disputes

If you experience a problem with a fuel request, including incorrect quantity or failure to receive the fuel requested, report it through the GoFuel application or support channel as soon as possible.

GoFuel will investigate reported disputes and seek to resolve them in accordance with its applicable dispute-resolution procedures.

7. Loyalty Score and Credit Limits

Your eligibility and credit limits may be assessed using factors including:

• Number of successful transactions.
• Credit repayment history.
• Wallet activity and savings behavior.
• Account age.
• Identity verification status.
• Other relevant risk and fraud-prevention indicators.

A higher loyalty or risk score may increase credit eligibility or limits, subject to applicable criteria. Late payments, failed transactions, fraudulent activity, and other risk indicators may negatively affect eligibility.

8. Identity Verification and BVN

• Identity verification may be required to access Fuel Assist Credit.
• We may use third-party identity-verification providers to verify identity information.
• By providing your BVN or other verification information, you consent to the applicable verification processes.
• We apply appropriate safeguards to protect verification information.
• Providing false or inaccurate information may result in account restrictions or termination.

9. Location Services

• GoFuel uses device location to show nearby participating stations.
• Location access is requested through your device permissions.
• You can disable location access through your device settings, although this may limit map functionality.

10. Push Notifications

• We may send transaction updates, payment reminders, security alerts, and service notifications.
• You can disable non-essential notifications through your device or application settings.
• Important transactional or security communications may still be sent where necessary.

11. Prohibited Activities

You agree not to:

• Use the Service for an illegal or unauthorized purpose.
• Provide false or misleading information.
• Attempt to access another user's account.
• Reverse engineer, decompile, or disassemble the application.
• Use automated tools to abuse or interfere with the Service.
• Engage in fraudulent transactions or credit abuse.
• Harass, threaten, or abuse users, employees, or vendors.
• Interfere with the operation or security of the Service.
• Violate applicable laws or regulations.

12. Intellectual Property

All content, features, functionality, text, graphics, logos, icons, images, software, and other materials forming part of the Service are owned by or licensed to JCobiq Energy Solutions and are protected by applicable intellectual-property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal purposes. You may not copy, modify, distribute, reverse engineer, or create derivative works from the Service without written permission, except where permitted by law.

13. Disclaimers and Limitations of Liability

13.1 Service "As Is"

The Service is provided on an "as available" basis to the maximum extent permitted by applicable law. We do not guarantee that every feature, vendor, payment method, or fuel station will always be available.

13.2 No Guarantee of Availability

We do not guarantee that:

• The Service will always be uninterrupted or error-free.
• Partner stations will always have fuel available.
• All fuel requests will be approved or fulfilled.
• Third-party payment, banking, identity, telecommunications, or infrastructure services will always be available.

13.3 Limitation of Liability

To the maximum extent permitted by law, JCobiq Energy Solutions shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from circumstances beyond our reasonable control.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable Nigerian law.

14. Indemnification

You agree, to the extent permitted by applicable law, to indemnify and hold harmless JCobiq Energy Solutions and its affiliates, officers, directors, employees, and agents against claims arising from your unlawful use of the Service, fraud, violation of these Terms, or failure to meet your lawful credit obligations.

15. Dispute Resolution

15.1 Informal Resolution

If you have a dispute with GoFuel, contact us at support@gofuel.ng so that we can attempt to resolve the matter informally.

15.2 Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria.

15.3 Arbitration

Where arbitration is legally applicable, disputes may be referred to arbitration in accordance with applicable Nigerian arbitration law. Nothing in this section prevents a consumer from exercising any mandatory statutory right or remedy.

16. Changes to Terms

We may update these Terms from time to time. Material changes may be communicated through the application, email, push notification, or other appropriate means.

Where required by law, we may require you to accept updated Terms before continuing to use affected services.

17. Termination

17.1 Termination by You

You may request termination of your GoFuel account by contacting support@gofuel.ng. Any outstanding credit obligation remains payable after account termination.

17.2 Termination by Us

We may suspend or terminate your account where permitted by law, including for fraud, material violations of these Terms, persistent non-payment, or regulatory requirements.

17.3 Effect of Termination

Termination does not cancel outstanding payment or credit obligations. Certain information may be retained where required by law or for legitimate business, security, fraud-prevention, dispute-resolution, or regulatory purposes.

18. Miscellaneous

18.1 Entire Agreement

These Terms, together with our Privacy Policy and any specific terms presented for particular GoFuel services, constitute the agreement governing your use of the Service.

18.2 Severability

If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

18.3 Waiver

Our failure to enforce a provision does not constitute a waiver of that provision.

18.4 Assignment

You may not assign your account or rights under these Terms without our written consent, except where permitted by applicable law.

18.5 Force Majeure

We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including network outages, infrastructure failures, natural disasters, government actions, or failures of third-party service providers.

19. Regulatory Compliance

GoFuel is committed to complying with applicable Nigerian consumer protection, data-protection, payment, financial, and other regulatory requirements applicable to the services it provides.

Where a regulated service is provided through a licensed third-party provider or financial institution, the applicable provider's regulatory terms and requirements may also apply.
